Ibiza court rules woman knowingly made false rape claims against Guy Gerber

A woman has been given a 15-month-and-one-day prison sentence in Ibiza for a continuous offence of libel with publicity after she accused Guy Gerber on social media of drugging and sexually assaulting her during a party in Mykonos in 2013.

The ruling, issued by Criminal Court No. 1 of Ibiza, states that “the rape of which Gerber is accused did not occur”. The accusation originated in an Instagram post that spread to nearly one million accounts, forming the basis of a wider online campaign titled Our Time Is Now, in which the woman urged other alleged victims of the DJ to speak out.

However, the court concluded that the allegation was false, that social media virality was deliberately used to damage the artist, and that his reputation was attacked without supporting evidence. Judge Clara Ramirez de Arellano ruled that the woman “knowingly attributed to Gerber a crime of rape, knowing it to be false”.

According to the court decision, reported by La Voz de Ibiza, the woman never filed a police report, did not seek medical attention, and did not inform her immediate family of the alleged incident, despite working at a law firm and having access to legal advice. The sentence notes that “it is surprising the attitude of the defendant, who in the face of the seriousness of the facts that she herself published in her social networks and having the possibility of obtaining legal advice (…) did not tell anyone anything”. The court also ordered the convicted woman to publish the full ruling on her social media accounts for a period of six months.

In her original account, the woman said she met Gerber on 27 July 2013 in Mykonos, claiming that he offered her “a line of stimulant drug and a shot of alcohol” while she was sober. She alleged that shortly afterwards she lost mobility and later regained consciousness hours later in a room with Gerber, stating, “I regained consciousness about four or five hours later, woke up totally confused, next to him, naked in bed, with no memory of what had happened and intense pain between my legs.” She also claimed to have had bruises that lasted several days, which she said she did not report at the time due to memory loss.

Gerber, represented by lawyer Jaime Campaner, maintained throughout the proceedings that the encounter was entirely consensual, that no aggression took place, and that no substance was administered to override the woman’s will. The judge ultimately found it proven that Gerber and the complainant engaged in consensual sex at the home of a mutual friend during a party in Mykonos on the night of 21 July 2013, concluding that “Gerber did not commit any crime and acted at all times with the consent of the other party.”

The ruling further challenges the credibility of the woman’s claims, citing the absence of medical evidence, witnesses, or toxicological tests to support the alleged use of Rohypnol, a drug commonly associated with cases of chemical submission. Although the accusations were ultimately found to be false, the court acknowledged that the media impact had serious consequences for Gerber’s career, noting that “several contracts were canceled to the DJ (including several in Ibiza nightclubs) that would have meant a very high income for him.”

Despite this, the magistrate highlighted that Gerber chose not to seek financial compensation, stating positively that “he has even waived any compensation that might correspond to him, despite the serious moral damage caused to him and his family.”

During the trial, it also emerged that the woman had publicly accused another man in March 2022 of a similar alleged assault in Ibiza, again involving claims of chemical submission with Rohypnol, without filing a formal complaint or undergoing medical examinations in that case either.
